One of our senior lawyers has considerable legal experience in dealing with regulatory requirements which are faced by entities operating in the Health and Aged Care Centre. In addition, dealing with insurance issues such as personal injury claims made against such entities and also claims pertaining to defective building work at Health and Aged Care facilities.

We have assisted both government and private clients with both investigations and responding to claims pertaining to employment issues, workplace practices, misappropriation of funds/assets and WorkCover investigations as they relate to the Health and Aged Care sector.

OUR EXPERIENCE

Assisted a pharmacy business with retail and compounding branches to negotiate the terms of leases, dispute outgoings charges, restructure to buy out a partner, respond to an inquiry from the regulator about compounding and dispensing a restricted drug.

Sale of a privately owned hospital to a major medical property aggregator, including ensuring the sublessees were compliant with the Retail Shop Leases Act 1994 (Qld). A new lease to Vodafone was negotiated and agreed prior to settlement, relating to a mobile phone tower.

Acted for the franchisee of a home care franchised business in dispute with the franchisor over various operational matters. The matter first involved reviewing and responding to a Breach Notice issued by the franchisor, ongoing correspondence leading to a 2-day mediation, review and negotiation of a settlement deed, and subsequent dealings with the client to ensure compliance with the settlement deed with an anticipated sale of the business.

Acted for a client in the purchase of a physiotherapy business. This involved reviewing and negotiating the business sale contract, reviewing and negotiating the deed of assignment of lease, and drafting new contractor agreements for the engagement of physiotherapists.

Acted for a client (as tenant) who operates a national hearing clinic in several leasing matters, including new leases and renewals in QLD and NSW, involving review and negotiation of the documents.
