NATIVE TITLE & CULTURAL HERITAGE LAW

We have been advising on Native Title issues since its inception in 1993.

Our Native Title and Cultural Heritage Team operate nationally with offices in every State.

We have a deep understanding of the requirements of government, project developers and First Nations Peoples in the management of issues relating to Native Title, Indigenous cultural heritage and Indigenous land rights.

The team has acted on the largest engagements in Australia, whether that be on major projects, policy development or on the development of Australia’s first treaties with First Nations Peoples.

WE CAN HELP WITH

  • Indigenous corporation law

  • Native Title procedures for project development

  • Indigenous Agreements such as RTN, s31 and CHMP Agreements

OUR EXPERIENCE

Acted for an Aboriginal Corporation in relation to impacts of a mining project on its pastoral holdings activities, native title rights and cultural heritage.

Confidential Water Pipeline and other infrastructure for a project: Acted for confidential client on all Native Title aspects for development of infrastructure corridors for a large project. This involved working closely with a Native Title negotiator who was previously a member of the National Native Title Tribunal, on coordination of negotiation of various agreements with numerous Native Title groups across a large area, to enable harmonious development of the project. The resultant agreements included an overall trust arrangement to administer and facilitate benefits to all affected Native Title holders for a long term solution.

Acted in resolution of Native Title and Cultural Heritage issues for the Wilpingjong Project. This resulted in the first Native Title Agreement that established a trust company to administer benefits for the Indigenous Group.

Wilpinjong Coal Project: Acted in resolution of Native Title and Cultural Heritage issues for the Wilpinjong Project. This resulted in the first Native Title Agreements that established a trust company to administer benefits for the Indigenous Group.

South Blackwater Coal Mine: Successfully defended a Good Faith application in the National Native Title Tribunal. See http://www.austlii.edu.au/cgi-bin/sinodisp/au/cases/cth/NNTTA/2001/23.html?stem=0&synonyms=0&query=south%20blackwater%20coal
